These terms and conditions govern your use of our website. Please read these terms in full before you use this website. If you do not accept these terms and conditions, please do not use this website. Your continued use of this website confirms your acceptance of these terms.

Website Access

1.1 It is not necessary to register with us in order to use this website. 

Use of Website

1.2 This website may be used for your own private purposes and in accordance with these terms and conditions.

1.3 You may print and download material from this Website provided that you do not modify or reproduce any content without our prior written consent.

Website Uptime

1.4 All reasonable measures are taken by us to ensure that this website is operational all day, every day. However, occasionally technical issues may result in some downtime and accordingly we will not be liable if this website is unavailable at any time.

1.5 Where possible we always try to give advance warning of maintenance issues that may result in website downtime but we shall not be obliged to provide such notice.

Visitor Provided Material

1.6 Any material that a visitor to this Website sends or posts to this website shall be considered non-proprietary and non-confidential. We shall be entitled to copy, disclose, distribute or use for such other purpose as we deem appropriate all material provided to us, with the exception of personal information, the use of which is covered under our Privacy Policy.

1.7 When using this website you shall not post or send to or from this Website any material:

  • (a) for which you have not obtained all necessary consents;
  • (b) that is discriminatory, obscene, pornographic, defamatory, liable to incite racial hatred, in breach of confidentiality or privacy, which may cause annoyance or inconvenience to others, which encourages or constitutes conduct that would be deemed a criminal offence, give rise to civil liability, or otherwise is contrary to the law in Quebec
  • (c) which is harmful in nature including, and without limitation, computer viruses, Trojan horses, corrupted data, or other potentially harmful software or data.

1.8 We will fully co-operate with any law enforcement authorities or court order requiring us to disclose the identity or other details of any person posting material to this website in breach of Paragraph 1.7.


1.9 Whilst we do take all reasonable steps to make sure that the information on this website is up to date and accurate at all times we do not guarantee that all material is accurate and, or up to date.

1.10 All material contained on this website is provided without any or warranty of any kind. You use the material on this website at your own discretion.

Promotional Codes

1.11 Promotional codes are only redeemable on the Haute Balloon website and cannot be used in conjunction with any other promotional activity.

1.12 Promotional codes generated by Haute Balloon are only redeemable on the Haute Balloon website and are not valid on any of our partner sites.

1.13 Haute Balloon reserves the right to cancel Promotional Codes at any time.

1.14 Promotional Codes for the Haute Balloon website are not redeemable against existing orders placed before the promotional code has been generated.

1.15 Promotional Codes, unless otherwise stated, are not valid for phone or email orders.

Exclusion of Liability

1.16 We do not accept liability for any loss or damage that you suffer as a result of using this website.

1.17 Nothing in these terms and conditions shall exclude or limit liability for death or personal injury caused by negligence which cannot be excluded or under the law of Quebec,Canada.


1.18 Any customisable features on hauteballoon.com and associated websites are designed to be a representation. Haute balloon reserve the right for the creative license over its products and will provide personalisation in the most effective way for the size, shape and layout of the chosen product. No refunds, discounts or compensation will be available for the personalisation style differing from that shown within the customise box. In addition no exchange or refund shall be granted should any balloon product pop or deflate after delivery or client pick up has been made of the Haute Balloon item.

Delivery & Collection

1.19 Haute balloon offers local delivery within a 4 hour window of timeline for the hour client selects.  Haute Balloon will not be held liable should an order arrive up to one hour late of schedule time due to unforeseen delivery conflicts of issues

1.20 If a collection is requested and the balloons are not picked up on the desired date, we are unable to provide a refund. If the balloons have begun to deflate, you will be charged for the reinflation. This is due to the balloons being perishable and personalised and therefore unusable for another customer. 

Changes To Your Order

1.21 Haute Balloon will always try and be accommodating to changes where possible. If you have any essential changes that you'd like to make to your inflated or personalised order, we need a minimum of 2 working days prior to your order being due for delivery to make these amendments and depending on the request there may be an amendment charge. 

1.22 If amendments to the delivery address are required, please email or call us with the changes - sales@hauteballoon.com. If the item has been dispatched, any changes to the delivery address will incur a 24-hour delay on delivery.

Exchanges, Refunds and Returns

1.23 We are unable to accept returns of inflated and personalised orders. Due to their nature, they are perishable and individually created for each customer, therefore, cannot be reused or resold. If your items are faulty this does not affect your statutory rights.

1.24 Due to the perishable nature of our products, sometimes they may arrive not looking as intended. All of our balloons are assembled by an incredibly dedicated and passionate team who don't allow any items to leave our studio unless they are absolutely perfect. Should your balloons end up damaged in transit, please email us a picture of your product upon arrival and we'll do all we can to rectify. 

1.25 We are unable to issue discounts or refunds if an image of the faulty item isn't provided within 2 hours of arrival. 

Data Protection

1.26 We are unable to discuss orders of any nature with the recipient of the items if they are not also the billable customer. For any queries regarding the order you've received, please have the billable customer get in contact with us.

Law and Jurisdiction

These terms and conditions are governed by Quebec and Canada Law. Any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of Quebec and or Canada.
